VA Loans in Illinois — the State Where VA Lets You Pay the Lawyer

Illinois closings customarily involve a lawyer for each side. That is the state's defining transaction fact, and for a VA buyer it collides with a federal rule in a way worth understanding.

VA limits what a veteran may be charged, and an attorney fee ordinarily falls outside it. Illinois is a named exception.

The named exception

VA publishes a State Fees and Charges Deviations List — the per-state exceptions from fees normally considered unallowable. The Illinois entry lists:

What that means when you are budgeting

Allowable is not automatic, and it is not unlimited. A deviation permits a charge; it does not require you to pay it, set its size, or stop you negotiating it to the seller in the contract.

What it does mean is that you should expect the line to be there rather than assume the VA rules will strip it out. A Georgia veteran and an Illinois veteran reading the same national VA article will get different answers, and only one of them is right for their file.

Ask for the attorney fee and the closing protection letter as named lines on your estimate. Both are allowable in Illinois specifically.

The Mortgage Credit Certificate line is a hint

The fourth item on the Illinois entry — processing costs for participation in the Illinois Mortgage Credit Certificate Program, capped at $500 — is worth noticing for a reason beyond the number.

VA named it, which means veterans use it. A mortgage credit certificate is a separate state-administered benefit that can sit alongside a VA loan rather than competing with it, and the fact that VA wrote a fee allowance for it says the combination is common enough to need one.

Whether it fits your file is a real question rather than a given, and it is worth raising at application rather than discovering afterward.

Transfer tax can stack, and a VA buyer feels it

Illinois transfer tax is imposed at more than one level and can stack — state, county and municipal. The Illinois page has the structure.

For a VA purchase the thing to establish early is allocation. Municipal transfer taxes in particular sometimes fall on the buyer by local ordinance and sometimes on the seller, and that is a local question rather than a statewide one. A VA buyer bringing no down payment has less flexibility to absorb a surprise, which makes it worth pinning down before the offer rather than after.

The seller customarily provides your owner's policy

Illinois is one of the few states where an actual authority describes the custom: the Illinois State Bar reports that in most Illinois communities sellers commonly provide the buyer's owner policy.

Custom is not law and the contract still governs — but it is a genuinely favourable starting position, and unusual. Across the country most states have no authority on this at all.

Where the buyers are

Naval Station Great Lakes north of Chicago is the Navy's only boot camp, which means a continuous flow of sailors and their families through Lake County. Scott Air Force Base anchors the Metro East area opposite St. Louis, and Rock Island Arsenal sits on the Mississippi at the Quad Cities.

If you are buying near Scott, note that the metro crosses into Missouri, which differs on nearly everything above. Confirm which state the property is in before pricing anything.

What I would ask for by name: the attorney fee and the closing protection letter, as separate lines. Both are allowable in Illinois specifically, and a line you expected is a line you can negotiate.
