VA Loans in Georgia — the One Fee VA Lets Georgia Charge You

VA caps what a veteran may be charged, which is one of the benefit's quieter protections: a fee outside the allowable list is unallowable, and it lands on somebody other than you.

Georgia has a written exception, and it is worth knowing before you see it on a closing statement.

The exception, in VA's own words

VA publishes a State Fees and Charges Deviations List — the exceptions, state by state, from fees normally considered unallowable. Its own change log records:

August 13, 2020 — Georgia (GA) and Florida (FL): Add "intangible tax" as an allowable fee.

The version current as of February 17, 2026 still carries it, along with a Georgia Residential Mortgage Fee of $10.

So the intangible recording tax may be charged to you on a Georgia VA loan. In most states a charge calculated against your loan amount would not survive the unallowable rule. Here VA named Georgia and made room for it.

This is not the funding fee and not the 1% flat charge — both of those are separate, and the deviations list sits alongside them rather than inside them.

Which matters because the tax is not small

Georgia's intangible recording tax applies when an instrument securing a long-term note is recorded, at a rate set against the face amount of the note. The Georgia page has the mechanism and the refinance exemption.

Two things follow for a VA buyer specifically:

It scales with your loan. A no-down-payment VA purchase finances more than a conventional one with money down, so the base the tax is calculated on is larger. The benefit that lets you keep your cash also enlarges this particular line.

Georgia law makes the lender legally responsible for it, while the Department of Revenue permits the cost to be passed along — and VA's deviation is what permits it to be passed to you rather than absorbed. Two separate permissions pointing the same direction.

Ask for it as a named line on your estimate rather than discovering it in the total. It is allowable, not automatic, and like any cost it can be negotiated to the seller in the contract.

Price your scenario and Georgia's transaction taxes are in the figure rather than a national average that models neither.

The exemption that changes your payment, not your closing

Separate from closing costs and larger over time: Georgia's disabled veteran homestead exemption.

The Department of Veterans Service sets eligibility as an honorably discharged Georgia veteran who is VA-rated 100 percent totally disabled, or rated less than 100 percent but entitled to the 100 percent rate due to unemployability, or entitled to a statutory VA award for loss or permanent loss of use of feet, hands or sight. You must own the home and use it as your primary residence.

The amount is the greater of a fixed statutory floor or the federal maximum indexed annually by the Secretary of Veterans Affairs under 38 U.S.C. 2102 — I am not printing this year's figure, because it moves. Value above the exempt amount stays taxable.

It extends to an un-remarried surviving spouse or minor children for as long as they occupy the home.

Why it belongs on a mortgage page rather than a tax one: the payment underwriting measures includes property taxes. An exemption of this size does not just save money after closing — it changes the payment being qualified, which can change what you are working with. Raise it at application rather than after.

You apply through your county tax commissioner, not the state. Georgia has 159 counties administering this, so the office is local and the deadline is worth confirming there.

Your closing will be run by an attorney

Georgia requires an attorney to conduct a residential closing, which is unusual and which VA files handle routinely.

For a VA buyer the useful consequence is that a lawyer is reading the documents. The attorney is conducting the closing rather than representing you unless separately engaged — but it is a materially different room from a state where a non-attorney settlement agent runs it and nobody present can answer a legal question.

Note also that VA's Georgia deviation does not list an attorney fee, unlike neighbouring entries for other states. What a Georgia veteran may be charged for legal work follows the ordinary allowable rules, so it is a question to ask rather than assume.

Where the buyers are

Georgia carries one of the larger active-duty and veteran populations in the country — Fort Stewart and Hunter Army Airfield near Savannah, Fort Moore at Columbus, Robins Air Force Base at Warner Robins, and Kings Bay on the coast.

Practically that means listing agents in these markets see VA offers constantly and know how they close, which is not true everywhere and is worth knowing when you are deciding how to write.

What I would raise on day one: the exemption, if it applies to you. Everything else on this page is a cost to plan around; that one changes the payment being measured, and only if it is documented in time.
