"What Does the Closing Attorney Do When I Buy a Home in Georgia?"

If you are moving to Georgia from a state where you signed at a title office, you may expect the closing appointment to work the same way. Before you book travel or take time off, I would get the closing attorney's instructions.
Georgia treats a real estate closing as legal work. The closing lawyer must control the transaction from beginning to end; a lawyer who only witnesses signatures does not satisfy that responsibility. The State Bar of Georgia's approved Formal Advisory Opinions 86-5 and 13-1 explain the rule.
I'm Jeff Moran, a mortgage broker in Bluffton, South Carolina, originating since 1996, licensed in fifteen states, including Georgia, NMLS #483943, through C2 Financial Corporation.
Why does that matter before the appointment?
I want you to know which office is handling the closing and how to reach it while there is still time to ask questions. The attorney's role is part of how a Georgia closing works, so I would include that office in your planning early.
Ask who your contact is, when the office expects to have documents ready for review, and what it needs from you. Put those answers beside the lender's requests. If the two lists seem inconsistent, send the question to both of us so we can resolve it before you arrange your day around an assumption.
My part is helping with the loan and your Georgia pre-approval. For a question about the legal effect of a document, I want the attorney involved.
Does the closing lawyer represent me?
That is a question I would ask directly. “Who do you represent in this transaction, and which questions can you advise me on?” is much more useful than assuming the answer from the name on the office door.
If you have a concern about ownership, a contract term, an estate, or something you are being asked to sign, describe that concern when you call. Ask whether you need separate counsel for it. You do not have to diagnose the legal issue before asking who can help you understand it.
The approved Georgia advisory opinions establish the lawyer's closing responsibility. I would still confirm the representation arrangement for your own file rather than turn that general rule into a promise about whose individual interests a particular lawyer represents.
What should I confirm about signing and sending money?
Give the closing office your availability and ask how it plans to conduct your signing. If you will be out of state, say so before buying a plane ticket or arranging an alternate signer. Get the office's approval of the proposed arrangement and tell your lender about it.
I am not promising that a particular remote signing or power of attorney will work for your transaction. The documents and the proposed method need review by the people responsible for closing your file.
For funds, ask for the amount, deadline, and verification process. Use the precautions in the contract-to-closing timeline. If instructions change, pause and call the closing office using a number you have independently verified. Give yourself enough time to resolve a question without pressure to send money immediately.
What would I put on my closing-week list?
I would have the office's contact details, my signing arrangement, the documents available for advance review, and the funds instructions in one place. Then I would compare those with the title issues before closing.
For an invented example, suppose a buyer plans to leave Georgia two days before the scheduled signing. A conversation with the closing office before booking travel can establish whether the plan works or needs to change. Discovering that conflict at the airport leaves everyone fewer choices.
If you also have a tax filing to handle, keep the Georgia homestead exemption on your after-closing list. Having a closing appointment on the calendar gives you a useful time to organize the next steps.
Common questions
Is the Georgia closing attorney only there to watch me sign?
No. The approved State Bar opinions describe responsibility for the closing beyond witnessing signatures.
Can I assume the closing attorney is my personal lawyer?
Ask the office who it represents and whether it can advise you on your particular concern. Get that answer before relying on an assumption.
Can I sign from another state?
Give the closing office and lender your proposed location and method early. Get the arrangement approved for your file before making travel plans around it.
Who should answer a question about a legal document?
Start with the closing attorney, explain the concern, and ask whether separate counsel is needed. I can help identify the loan question that needs an answer alongside it.
If you are preparing to buy in Georgia, run your numbers and we can work through the loan timeline and the questions to take to your closing attorney.
