FHA Loans in Wisconsin: Why Your Spouse's Debts Count Even When They Are Not on the Loan
A married Wisconsin couple decides that one spouse will apply for the FHA loan alone, because that spouse has the stronger credit and the steadier paycheck. The lender asks for a credit report on the other spouse anyway.
That request comes from a rule in HUD's Handbook 4000.1, and it applies in community property states, which include Wisconsin. In a community property state, an FHA lender must pull a credit report on a spouse who is not on the loan, and that spouse's debts count in the client's debt-to-income ratio unless state law specifically excludes them. The debt-to-income ratio compares your monthly debt payments with your monthly income.
I'm Jeff Moran, NMLS #483943, licensed to originate in Wisconsin through C2 Financial Corporation, and I have been in the mortgage business since 1996. The FHA explainer covers how the program works everywhere, and the Wisconsin page covers the state's closing rules.
Is Wisconsin a community property state for FHA?
IRS Publication 555 says it is written for married taxpayers domiciled in one of its community property states: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin. Wisconsin calls its version marital property, and the Wisconsin page explains how that works at the closing table.
The FHA handbook says "community property state" without printing a list. The rule applies when the client lives in such a state or the home is in one. Wisconsin is on the IRS list, so these requirements apply to a Wisconsin file.
What does FHA ask about a spouse who is not on the loan?
Four things, all from the handbook:
- A credit report. The lender must get one on the spouse unless state law excludes it. It can be a standard credit report or a non-traditional one, which a credit reporting agency builds from credit references that do not appear on a standard report.
- Debts in the ratio. The spouse's debts go into the client's debt-to-income ratio, except obligations specifically excluded by state law. The lender must also note in the file which state law justifies any exclusion.
- Collections. A spouse's collection accounts count toward the lender's total of collections on the file. When that total reaches $2,000, the lender needs the debt paid, a payment arrangement, or a monthly payment of 5 percent of the balance counted in the ratio.
- Judgments. A spouse's court judgments must be resolved or paid in full, again except where state law excludes them.
Two things work in your favor. The handbook says the spouse's credit history is not considered a reason to deny the application. A spouse's disputed collection accounts, charge-offs and late payments are left out of the total that can send a file to manual underwriting, a full review by an underwriter.
Whether Wisconsin law excludes a particular debt is a legal question about that debt, and I won't promise an answer in advance. I will ask about your spouse on our first call, even when your spouse will not be signing the note.
Does my spouse have to sign the mortgage?
The handbook says a spouse in a community property state is not required to be on the loan or to cosign, but the mortgage must be signed by everyone needed to make the lien valid under state law. A lien is the lender's legal claim on the home. If necessary, the lender requires a spouse who is not on the loan to sign the mortgage or give up their rights to the property.
Wisconsin's own rule is on the state page. On the loan that buys the home, only the purchaser needs to sign. On a refinance of a homestead both spouses sign the mortgage, and the spouse who is not on the loan takes on no debt by doing so.
What are the 2026 FHA loan limits in Wisconsin?
HUD published them in Mortgagee Letter 2025-23 for FHA loans whose case numbers were assigned on or after January 1, 2026. The floor is the lowest limit FHA sets anywhere, and 70 of Wisconsin's 72 counties are at it. The two exceptions are Pierce and St. Croix counties, part of the Minneapolis-St. Paul metro.
| Area | One unit | Two units | Three units | Four units |
|---|---|---|---|---|
| 70 counties at the floor | $541,287 | $693,050 | $837,700 | $1,041,125 |
| Pierce and St. Croix | $552,000 | $706,650 | $854,200 | $1,061,550 |
WBAY reported that the Wisconsin REALTORS Association put the statewide median sale price at $362,000 in August 2026, which is $179,287 under the one-unit floor.
The two-unit limit matters in Milwaukee, where the housing stock includes many two-family homes, among them the Polish flat, a two-family home with the units stacked and each with its own entrance. The handbook says FHA's single-family programs cover one- to four-family properties that you will occupy as your principal residence, so a client who lives in one unit of a two-family home can use the $693,050 limit. My Milwaukee page has more.
How much cash does an FHA loan take in Wisconsin?
The handbook requires you to put in at least 3.5 percent of the home's value, which is the lesser of the price or the appraised value, and it calls that cash the minimum required investment. Closing costs are in addition to that. Under the state's standard offer to purchase, the seller provides the owner's title policy, which takes a cost off your side of the sheet. The closing fee is set county by county, and sellers and other interested parties may also contribute up to 6 percent of the price toward closing costs, but never toward the minimum required investment.
Where to start
When you're ready, you can see rates and the payment for a home in your price range, with Wisconsin closing costs for your county included, and you choose the option that works best for you. Which loan fits puts FHA next to conventional and VA, and how to get pre-approved explains what I will ask for.
Nothing here is a loan approval, a denial, or a commitment to lend, and final approval depends on the property, the appraisal and full underwriting. Limits and premiums are revised periodically, so please confirm current figures with me.
Common questions
Is Wisconsin a community property state for an FHA loan?
IRS Publication 555 lists Wisconsin among its community property states, so the FHA rules for those states apply to a Wisconsin file. In Wisconsin the same idea goes by marital property.
Does FHA count my spouse's debts if my spouse is not on the loan?
Yes, in a community property state, except for obligations specifically excluded by state law. The lender also gets a credit report on the spouse. The spouse's credit history is not a reason to deny the application.
Does my spouse have to sign my FHA mortgage in Wisconsin?
A spouse does not have to be on the loan. The mortgage must be signed by everyone needed to make the lien valid, and on a refinance of a homestead that includes both spouses in Wisconsin.
What is the FHA loan limit in Wisconsin in 2026?
Seventy of the state's 72 counties are at the national floor for a one-unit home. Pierce and St. Croix counties are slightly higher. The limit applies to FHA loans whose case numbers were assigned on or after January 1, 2026.
Can I use FHA on a two-family home in Milwaukee?
Yes, if you will live in one of the units. FHA's single-family programs cover one- to four-family properties that you occupy as your principal residence, and the two-unit limit is higher than the one-unit limit.
