Self-Employed in Alabama — They May Ask You for a Document That No Longer Exists
If someone on your loan asks for your Alabama LLC's annual report, there is nothing to send them. Alabama LLCs do not file one, and a request for it is a checklist that has not caught up rather than a problem with your business.
How your self-employed income gets counted is federal and identical everywhere — what an underwriter actually does with your returns is here. What Alabama adds is a set of expectations that changed recently enough that plenty of paperwork still assumes the old ones.

What changed, and when
Alabama restructured its system beginning January 1, 2024. The Department of Revenue states that only domestic and foreign for-profit corporations and professional corporations file Secretary of State annual reports, and that reports from other entity types are not accepted.
The Secretary of State has since gone further, saying corporations are no longer required by law to file an annual report either, and no LLC annual-report form appears among its LLC filings.
So there is no annual report for an Alabama LLC to miss. No late fee, no administrative-dissolution clock running from a missed filing.
That is not the same as no obligations. The Secretary of State still provides dissolution and reinstatement filings, and registered-agent or tax problems are real — they simply have to be evaluated under their own rules rather than mislabelled as an annual-report default. The distinction matters because the cure is different depending on which one you actually have.
How does a lender confirm my business exists, then?
This is the practical question, and it has a clean answer.
Verification that the business exists is a standard step on any self-employed file, ordinarily performed shortly before closing rather than at application. Alabama's route runs through the Secretary of State's Business Entity Records search, which is public and searchable by name, entity number, or officer, agent or incorporator.
Where more is needed, the supplements are a certificate of existence, current tax documentation, and the activity-specific licence discussed below.
One caution worth carrying into the conversation: a search result confirms the entity's recorded existence and filing details. It is not proof that every tax obligation is current — a formal certificate of existence or tax compliance is a separate product. If someone needs the stronger document, that is a different request, and knowing which one is being asked for saves a round trip.
Why might I have no business privilege tax return?
Because you may correctly owe none, and this is the second place an Alabama file gets misread.
Alabama's business privilege tax remains tied to registered existence until an entity is legally dissolved or withdrawn. But for tax years beginning on or after January 1, 2024, an entity whose calculation would produce only the statutory minimum tax is exempt and does not file the return.
So a small or dormant Alabama LLC may have no current filing and be entirely compliant. The absence of that return is not by itself evidence of a problem — and if it gets read as one, the explanation is a rule change rather than anything about you.
Where a return is required, the form follows the classification: a limited-liability entity or disregarded entity generally uses Form PPT, while an LLC taxed as a corporation generally uses Form CPT.
Do not describe a dormant Alabama LLC as owing a minimum annual amount as a matter of course. Whether it files depends on the current calculation and the exemption.
Which return will an underwriter actually read?
That follows your tax election, and it is the one question worth answering before you gather anything.
Alabama imposes individual income tax. The Department of Revenue is direct that a single-member LLC is disregarded and does not file a separate Form 65 — the owner reports through the applicable individual return, including the federal business schedules Alabama requires.
An LLC that has elected corporate treatment follows the corporate return path instead.
Three classifications, three different sets of documents, three different analyses. A Schedule C business, an S corporation paying salary plus distributions, and a partnership issuing a K-1 are genuinely different files. How an S corporation owner's salary and distributions get treated is its own subject and catches people who assume the salary is the whole story.
Ask your accountant one question before you apply: how is the entity taxed? Everything downstream follows from the answer.
What about a business licence?
Alabama has activity-based state and county business privilege licences under Title 40, Chapter 12, issued by the county probate judge or licence commissioner in each county where the business operates.
Not every business category requires one, and the Department of Revenue directs owners to check the current handbook rather than assume. Municipal licensing is separate again and has to be checked with each city where you actually conduct business.
For a mortgage file, the licence matters when it is the natural document proving the business is operating — which is more often the case for a trade or a retail activity than for a consulting practice.
What the returns have to show
The income side is the ordinary federal one, and none of it changes at the Alabama line:
Two years of returns are the norm, with an established method for what happens when the two disagree rather than a judgment call. Both are explained here.
The net profit on a return is rarely the qualifying figure. Depreciation and other non-cash items are commonly added back, which is why a return that reads thin can support more than expected.
Conventional first. More of these files qualify conventionally than the internet believes, and it is worth establishing that before anyone reaches for a costlier product.
The rest of an Alabama file
Alabama's transaction costs have a shape worth knowing separately from your income: two recordation taxes, one on the deed and one on the mortgage, which most national calculators model neither of. The Alabama page has the structure, and the pre-approval version covers what that does to a cash-to-close figure.
If you served, Alabama VA loans covers HB77 and the tentative exemption certificate.
What I would settle first: how the entity is taxed, and whether the business licence applies to your activity. Those two answers determine every document request that follows, and both take one phone call rather than a week.
Where to start
Run your numbers — no credit pull, no account, nobody calls you. Rates for your scenario and a debt ratio built on your actual figures.
Nothing here is a loan approval, a denial, a commitment to lend, or tax advice. Alabama's filing rules changed recently and continue to change; confirm your entity's current obligations with the Department of Revenue, the Secretary of State or your tax professional.
Common questions
Does an Alabama LLC file an annual report?
No. Alabama restructured its system beginning January 1, 2024, and the Department of Revenue states that only domestic and foreign for-profit corporations and professional corporations file Secretary of State annual reports, with reports from other entity types not accepted. The Secretary of State has since said corporations are no longer required to file one either, and no LLC annual-report form appears among its LLC filings.
What if a lender asks for my Alabama LLC annual report?
There is nothing to produce, and that is the correct answer rather than a problem. The request is a checklist written before the change. The workable substitute is the Secretary of State's Business Entity Records search, supplemented where necessary by a certificate of existence, current tax documentation and the activity-specific licence.
Why does my Alabama LLC have no business privilege tax return?
Possibly because it correctly owes none. For tax years beginning on or after January 1, 2024, an entity whose calculation would produce only the statutory minimum tax is exempt and does not file the return. So a small or dormant Alabama LLC can have no current filing and be entirely compliant, and the absence of that return is not by itself evidence of a problem.
Does a single-member LLC file a separate Alabama return?
No. The Department of Revenue states that a single-member LLC is disregarded and does not file a separate Form 65 — the owner reports through the applicable individual return, including the federal business schedules Alabama requires. An LLC that elected corporate treatment follows the corporate return path instead, which is why the tax election is worth confirming before gathering documents.
Does an entity search prove my business is compliant?
Not entirely. The Secretary of State's Business Entity Records search confirms recorded existence and filing details, but a formal certificate of existence or tax compliance is a separate product. If a transaction specifically requires the stronger document, that is a different request — and establishing which one is being asked for early saves a round trip late.
Do I need an Alabama business licence for my mortgage file?
It depends on your activity rather than on having an LLC. Alabama has activity-based state and county business privilege licences under Title 40, Chapter 12, issued through the county probate judge or licence commissioner, and not every category requires one. Municipal licensing is separate. Where a licence does apply, it is often the most natural document proving the business is operating.
